I purchased this book based on positive reviews here on Amazon, and I disagree with those opinions of its usefulness.I purchased the book primarily for reliable drafts of contracts for wedding and event photography. The wedding photography segment is not thorough. The draft agreement leaves out a number of vital elements, and the book does not elsewhere discuss them. Other segments of the book appear to suffer from the same superficial treatment.I am a trademark attorney, and practiced at the US Patent and Trademark Office several years ago, and the trademark section of this book is a decade out of date. The author acknowledges the USPTO's preference for online filing, but then provides guidance only for paper filings, and the relevance of even that guidance is questionable. The guidance was clearly an afterthought, and the author put absolutely no current research (despite a number of recent revisions to the book) into the matter.I rate the book at two stars, rather than one star, because the author's explanation of negotiation processes demonstrates experience and insight, and can be valuable to photographers who have never entered into legal agreements about their work. However, the author's advice about trademark protection alone calls into question the value and accuracy of the remainder of the book, and the draft agreements I was hoping for are too shallow, so I cannot recommend the book.I would recommend John Harrington's Best Business Practices for Photographers, an excellent, very thorough, and up-to-date legal and business primer for photographers starting a business.
This is a great book for general content and advice on how to write a contract. Do not expect to take this book and copy the forms and have them be applicable to your business needs today. If I recall correctly, this book has a copyright date of 2001. At that point in time, there was not a heavy contingency of professional photographers shooting digital. The contracts contained within the book are geared towards film and negatives, and proofing books, which are largely becoming obsolete as digital continues to march ahead.Furthermore, the included CD-ROM of forms, do not port over to modern versions of Office suite products. I tried opening the forms in Office XP, Office 2007 and Office 2008 for Mac, and the formatting was largely lost. Check boxes were no longer recognized, and borders were lost.I'd recommend the book if you're looking for advice on what to put into a contract, not something that you can open the documents, make some edits, and be ready to go in 30 minutes.
I didn't originally buy this book to "read". I bought it for the invaluable resources inside - the wealth of forms that any photographer needs to protect their work and their business. What makes this book so enticing is you don't have to photocopy, or redesign any of the forms since they're all included on a CD that comes with the book. That being said, I should mention that I was quite surprised at the thorough explanation for each form, and the situations where each form might be needed contained in the book. A person could undoubtedly pay hundreds (probably thousands) in legal fees assembling the information in this book on their own. This book is a photographer's "legal-resource-in-a-book". I highly recommend it.
This title is a great addition to any photographer's library. If I ever need to find a contract or form to use, this book has it. If it doesn't have it, it does have something similar to what I need so I can adjust it to work for me.Speaking of working for me...the CD included with this title is a God send. It has all the forms from the book in RTF and Word form. This is nice because you can just go add names or make edits as you see fit without having to retype everything on a page.It also explains thing you need for each form if you want to create your own (such as basic guidelines for a consent form).I'd recommend this book to any photographer without an attorney or many years of business/legal experience.
Aside from the contracts themselves, the author provides you with a negotiating checklist for each contract to help you edit the documents to meet your personal job needs. It also helps prepare you for presenting the contract to your customer. Lots of helpful tips as well.One type of contract that I found missing is a release that allows a client to print and display the photos without totally transferring the copyright over. I like to keep my own rights to my work, while allowing clients to use them as well.The index could be easier to use. I tend to have to hunt for some types of contracts. Still, this book is a resource that is well worth it's price.
I purchased this book to assist me in writing contracts and model releases as well as a few others. I was disappointed when I looked on the CD for sample forms for Application for Copyright and Trademark Applications were not even there. I found better form through the Professional Photographers of America website as well as a few other sources.Save your money and listen to the 3 and below stars.
I bought this book because the description said you can download the forms. I thought it meant download from the net not CD-ROM. Not only that but Microsoft Word 6.0 for Mac or Word 95 for PC.
I like it and think it's fine. However, had I known sooner, I probably would not have purchased it, since, when it comes to release forms, "There's an app for that," called Easy Release. That's the route I'd take.
